Some illegal agencies wander around medical institutions, pretending to be new residents or business partners of the hospitals. They look for opportunities to introduce foreigners who are illegally residing in Taiwan to the family members of patients who are in urgent need of caregivers. If the family members have not verified their identities in advance and inadvertently hiring an illegal foreign caregiver will result in a fine of NT$150,000 to NT$750,000 for violating Employment Services Act.

According to the Ministry of Labor (MOL), there are recent cases of people receiving agency business cards in the hospital and hiring a temporary foreign caregiver to engage the works of short-term caregivers.

However, the Immigration Department’s Specialized Operation Corps found that the foreign caregiver was a “missing migrant worker”. As a result, the employer was fined. A reminder to all employers before hiring a temporary foreign caregiver, carefully check their identification card (ID) or the original copy of the valid Alien Residence Certificate. Confirm they are legally qualified to work to prevent yourself from being punished for violating the law due to negligence.

The public is reminded that it is the duty of every employer to assess the authenticity of agency advertisements and check foreign caregivers’ identities. When conducting inspections, the MOL will consider the circumstances in accordance with the law and approve appropriate legal penalties. Calling on the public to verify the identification of the caregiver to protect the mutual rights and interests of the employers and caregivers. If you have any doubts when checking relevant documents, you can also consult the local Labor Affairs Bureau or the National Immigration Agency service stations with photos or photocopies of the documents.
