The Legislative Yuan recently approved the "Act for Implementation of J.Y. Interpretation No. 748" (司法院釋字第748號解釋施行) in its third reading to address the change in the age of majority in civil law from 20 to 18. Therefore, in the future, no parental approval will be necessary for the establishment or dissolution of a same-sex marriage.

According to the "Act for Implementation of J.Y. Interpretation No. 748," "minors who enter into a same-sex marriage relationship shall obtain the consent of their legal representative," according to the Ministry of Justice. However, in order to be married, a person under the age of 20 still needs parental permission.
However, the Civil Code has decreased the legal age from 20 to 18 as of January 1 of this year. The Executive Yuan requested this amendment to be in line with Civil Code. Following the third reading by the Legislative Yuan, the approval of the legal representation is not necessary for the establishment or dissolution of a same-sex marriage as long as the person is 18 years old. The implementation date is also scheduled on January 1, 2023, which coincides with the day when the civil law's definition of adulthood would come into effect.
