In response to a CECC Level 3 travel warning in recent days, the legal limit is between 12 and 14 years for all other categories of migrant workers to work in Taiwan, according to the Ministry of Labor (MOL).
To date, the CECC has issued a Level 3 travel warning on March 19 for 99 countries and regions, including Indonesia, the Philippines, Vietnam, and Thailand. Since 4 p.m., March 16, all inbound migrant workers have to conduct home quarantine for 14 days.
According to Article 52 of the Employment Service Act, currently, the legal limit is 14 years for domestic helpers and 12 years for all other categories of migrant workers. Employers now have the option of seeking a three-month extension of the work contracts if their migrant employees will reach the legal limit for employment in Taiwan in the next three months. Migrant workers who are currently overseas and have re-entry permits will be allowed to return, but they will have to self-quarantine for 14 days if they are coming from a country that is under a CECC Level 3 travel warning, the ministry said.
According to Article 20 of the Regulations on the Permission and Administration of the Employment of Foreign Workers, upon approval that the employer may re-recruit foreign workers by the central competent authority, the employer shall not introduce or employ foreign workers before the originally employed foreign worker leaves Taiwan R.O.C. If the employer has applied for an extension, the employer shall not introduce or employ new foreign workers.
