Attract talent & retain talent! MOL revises "Regulations Governing Nationals without Registered Permanent Residence in the Taiwan"

In accordance with the attracting talent & retaining talent policy, the Ministry of the Interior (MOI) recently passed a draft amendment as follows. Taiwan nationals who have invested in Taiwan but without having household registration can apply for an extension of staying in Taiwan to find a job for up to one year. It is estimated that more than 300 people will be benefited after implementation of this policy.

MOI passed the amendment of "Regulations Governing Nationals without Registered Permanent Residence in the Taiwan Area Applying for the Entry Permit, Residence Certificate and Permanent Residence Certificate for Household Registration".

This revision of the law focuses on the relaxation of Regulations Governing Nationals without Registered Permanent Residence. Those nationals without household registration who reside in Taiwan for investment or employment, are able to apply for an extension of stay for 6 months before the expiry date first, and for another 6 months again of it is necessary. The total period of stay will be extended up to one year, increasing the willingness of non-registered nationals to stay in Taiwan and return to Taiwan.

MOI mentioned that the current regulations are applicable to children who stay with the aforementioned Taiwan nationals. However, the children must leave the country in accordance with restrictions if they cannot obtain other reasons for residence after they reach adulthood.

This revision of the law considers family reunification and thus there is a relaxation of the regulations. Children who stay with the aforementioned Taiwan nationals. After amendment of the regulations, their children who reach adulthood are able to legally reside in Taiwan for a total of 10 years and live for more than 270 days a year. For those under 16 years old, are able to live in Taiwan for more than 270 days each year, and can apply for extension of residence for a total of 6 years.
