Employers will be fined up to NT$750,000 if they hire migrant workers to do part-time jobs illegally

Most of the manufacturing factories in Taiwan will be closed during the Chinese New Year. This is therefore migrant workers are more likely to engage in part-time jobs illegally at food stalls and clinics, etc. during this period.

Labor Affairs Department, New Taipei City Government reminds employers to follow the “Employment Services Act” to avoid fines and penalties. Hiring international students or those who have ROC (Taiwan) Resident Certificates to do part-time jobs without approval from the government is also illegal, and employers will be fined up to NT$750,000.

Labor Affairs Department, New Taipei City Government reminds that if migrant workers choose to not have days off during Chinese New Year, caregivers can only take care of the one receiving long-term care but not others; factory workers can only work at the designated location but cannot carry works out of their job scope. Otherwise, one will be fined NT$150,000.

Employers are advised to provide appropriate leisure activities to migrant workers and have a grasp of their lives to prevent them from engaging in part-time jobs illegally.

As for overseas Chinese students and international students, they can only be employed if they have Alien Residence Certificate, student ID (card), or work permit and through legal procedures.

As for immigrants, they can be hired without the need to apply for a work permit from the Ministry of Labor. However, the original copy of their ROC (Taiwan) Resident Certificates, passports, and Dependent Relative should be checked to avoid hiring foreigners who pretend to be an immigrant.
