Be Careful when Hire the Migrant Worker, Avoid the Fraud with “333 Code”

Due to the impact of aging and declining birth, the demand for care takers manpower continues to increase. The Taipei Municipal Government Labor Bureau reminded public to understand the “333 Code”, check clearly, or contact the hospital care station directly, to know the entrusted care cooperation with the hospital, to protect you from the law.

The “333 Code” includes: do not hire the illegal foreigners, do not think that as long as both sides can receive it is ok and will not be realized it is illegal and the last, do not delay in reporting the illegal worker. Before hiring the migrant worker, please ask if the agency is the legal one or not, examine the documents, and take the picture for the evidence.

In addition, the employers should ask whether the employee ‘s identity is the new resident or the foreigner, check the authenticity of the residence permit and state whether the permit does not need or need to apply for the working permit. In the last, please check the validity period of the residence permit and the working permit.

The Labor Bureau pointed that the employers should apply for the foreign care takers by themselves. Regardless whether or not the payroll is paid, it is still illegal. Once the verification is true, the employers will be fined about $150.000 to $750.000 NTD. If you commit another crime within 5 years, you will be sentenced to imprisonment up to 3 years, detained or imposed the fine, with maximum $1,2 million NTD.

In addition, the illegal migrant workers or the person who entered Taiwan with a short-term visa might forge the documents to deceive the employers. When the employer hires the migrant worker, verify the authenticity of the transfer certificate, take photos and deposit certificates, if not approved and still hire them, you will get fined $150.000 to $750.000 NTD.
