Affected by the international pandemic, the number of migrant workers coming to Taiwan has dropped sharply, leading to an increase in "job transfers" by domestic care workers. To prevent the "wash worker phenomenon" from increasing, the Ministry of Labor (MOL, 勞動部) has amended the "Foreigners Employment Service Law" for this purpose. Article 46, paragraph 1, items 8 to 11 stipulate the change employer or job transfer procedure criteria", which clearly states that if migrant workers want to change jobs across a different industry, they must first go to a government-run employment service agency and first apply under "employers of the same job category" since it is the priority for hiring. If there is no registration by an employer in the same category for 14 consecutive days, only then can the migrant workers switch across industries. The new regulations will take effect immediately.

According to the MOL, for example, if family care workers want to transfer to a manufacturing factory, they must first go to a government-run employment service agency to apply, and only employers in the category of family care may register for employment renewal, and migrant workers can choose among the employers in the family care category. However, in accordance with the regulations, if the migrant workers decline to register under the family care category, they must return to their country after 60 days. Only if there is no family employer registration for 14 consecutive days, then migrant workers may switch jobs across industries.

Therefore, if migrant workers want to switch jobs across industries, they must first register with a government-run employment service agency. Within a certain period, they will be given priority to be employed by employers under the same job category. After 14 days, if there is still no new employer registration under the same job category, only then can employers in other job categories register and continue to hire the workers, and this new job transfer criteria for migrant workers will take effect immediately.
